By submitting your service order on www.alphasuretybonds.com (myAlphaSurety), you agree to the following terms and conditions.

Delivery & Timing: In most cases, Alpha Surety & Insurance Brokerage (ASIB) will process your order within two business days or less upon receipt of all the necessary information and documents. However, some bonds/policies may require additional time for underwriting and approval. If you selected the overnight option during the order process, after approval your bond/policy will be sent by overnight courier to the principal name and address on the order, unless we are specifically given another delivery name and address by you. If the overnight option was not selected, your bond/policy will be sent by regular mail through the United States Postal Service. It is your responsibility to ensure that the bond/policy is delivered to the appropriate obligee or insured, if necessary. ASIB will not be responsible for any rejection, action or omission of any obligee/insured, or for any loss, fine, interest or other penalty imposed by or incurred by any obligee/insured or any loss or damage incurred by you. Any such loss, damage, fines, interest or other penalties will be charged to and payable solely by you. ASIB cannot be responsible for delays, misdirections, loss, or damage to materials in the mail or through courier services, or delays caused by technical malfunctions or failures beyond ASIB’s control of telephone networks or computer systems by strikes, lockouts or other labor troubles, war, terrorism and force majeure factors. In the event that you have omitted any required information or failed to submit any required documents, we will promptly notify you of the deficiency, and the agreed time to complete the Services will begin when the required information and documents are received. In the event that you have submitted incorrect information in an order or wish to change the information, you are responsible for directing us to make such correction or change by logging onto myAlphaSurety and entering the replacement information. Please note that if you request us to reprocess or re-file a bond/policy after it has been sent to you because of inaccurate or changed information provided by you, we will charge you a $25 Change Order Fee as well as any applicable increase in premium that the change may have caused.

Payment: Upon approval of a cancelable new bond/policy, ASIB will send an invoice for the premium and any applicable service fees. Payment is due upon receipt and will be considered late and subject to cancellation if not paid within 15 days after the end of the month in which coverage is effected. For non-cancelable bonds/policies, payment may be required prior to issuance. On a renewal of an existing bond/policy, ASIB will usually send an invoice 45 or more days prior to the renewal date. All renewals will be subject to cancellation if payment is not received in our office by the renewal date. Notwithstanding the above invoicing procedures, payments may be made on myAlphaSurety with a credit card. Bond premiums are considered fully earned in the first year and shall not be subject to flat cancellation unless agreed to by the carrier and ASIB. In subsequent years, bond premiums are usually prorated, subject to carrier policies. Insurance policy refunds are always subject to carrier policies. Return premiums will be refunded to you within 90 days of the cancellation.

Term/Termination: This Agreement will commence on the date your order is placed. This Agreement may be terminated by either party upon the giving of written notice of termination, but such termination shall not alter in any way the continued application of this Agreement to bonds and policies in effect and any payments due as of the date of such termination.

Ownership: MyAlphaSurety is owned and operated by ASIB. No material from myAlphaSurety may be copied, reproduced, republished, displayed, uploaded, posted, transmitted or otherwise distributed in any way without our prior written permission.

Representations and Warranties: We represent and warrant that: (a) we have the full right and power to enter into this Agreement and to perform our obligations under this Agreement; (b) we will perform our obligations in a professional manner and at all times in accordance with this Agreement; and (c) we will use commercially reasonable efforts to ensure that any materials submitted or transmitted by us are free from any viruses, worms, trojan horses, or other items of a destructive nature. You represent and warrant that: (a) you have the full right and power to enter into this Agreement with respect to all of the terms and conditions contained herein and your entering into this Agreement shall not infringe on the rights of any third parties; (b) the information provided during the order processes is accurate to the best of your knowledge and that such information will not infringe on the rights of any third parties; (c) you will use commercially reasonable efforts to ensure that any materials submitted or transmitted by you are free from any viruses, worms, trojan horses, or other items of a destructive nature; and (d) you will use myAlphaSurety and the Services in a manner consistent with any applicable laws and regulations. Except as specifically set forth herein, ASIB makes no representations or warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, non-infringement and fitness for a particular purpose.

Disputes: The parties agree to submit to arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules (the “Rules”) with respect to any controversy or claim arising from or related to this Agreement, policies and/or applications.

Miscellaneous: You agree that we will not be responsible for the content or privacy policies of any web site that you link to from the ASIB Web site. Use of any linked sites is at your own risk. We reserve the right to change any provision of this Agreement at any time, which change shall become effective thirty (30) days after the date of written notice provided by us to you through the posting of such changes on myAlphaSurety. You agree that your failure to read or otherwise act on such written notification shall not affect the applicability or enforceability of such changes, so long as we make any such changes available for your review at your discretion on myAlphaSurety.
